Terms & Conditions
Welcome to Pröpr Pilates Studio (“Studio”, “Management”, “We”, “Us”, or “Our”). By booking a class, purchasing a credit package, signing up for a membership, entering our premises, or utilizing any of our services, you (“Client”, “Member”, or “Guest”) unreservedly agree to be bound by the following Terms & Conditions.

1. Exclusive Location & Village Rules
1.1 Gated Community Access: Pröpr Pilates Studio is situated within a private residential village in Cagayan de Oro City. Entry into the village and the Studio premises is a privilege, not a right.
1.2 Compliance with Village Regulations: Clients must strictly adhere to all homeowner association (HOA) rules, including speed limits, designated parking areas, security gate protocols, noise restrictions, and visitor clearance procedures.
1.3 Revocation of Access: Non-compliance with village regulations or security personnel may result in immediate suspension or revocation of Studio booking privileges without refund or compensation.
2. Membership & Package Eligibility
2.1 Age Minimum: Services are strictly reserved for individuals aged sixteen (16) years and above. Minors aged 16 to 17 require express written consent and a signed liability waiver from a parent or legal guardian.
2.2 Right of Refusal: Management reserves the absolute right to decline, suspend, or terminate memberships, package purchases, bookings, or studio access to any individual at its sole discretion, without liability.
3. Packages, Credits & Non-Refundability
3.1 Strict Non-Refundable Policy: All class credit packages, single sessions, memberships, promotional offers, and deposits are strictly final, non-refundable, and non-exchangeable under any circumstances, including but not limited to illness, medical diagnosis, relocation, scheduling conflicts, travel, or change of mind.
3.2 Non-Transferable & Non-Sharable: All packages and credits are tied exclusively to the registered account. Credit sharing, package splitting, or session transfers are strictly prohibited unless explicitly defined under a designated Studio promotion.
3.3 Expiration & Extensions: All credit packages carry a strict expiration date communicated at purchase. Expired credits are forfeit automatically. Extensions are not permitted under normal circumstances; any exceptional extension remains at the sole, unappealable discretion of Management and is subject to administrative processing fees.
4. Fees & Payments
4.1 Pre-Payment Required: Full payment must be cleared prior to reserving any class, private session, or service.
4.2 Price Adjustments: Management reserves the right to adjust service rates, packages, and schedule offerings at any time.
4.3 Finality of Payments: Once processed, all transactions are considered complete and non-refundable. Any disputed chargebacks or unresolved balances will result in immediate account termination and potential legal action to recover outstanding fees.
5. Bookings, Attendance & Class Operations
5.1 Advance Reservations: All group classes, reform/equipment sessions, and private appointments must be reserved via the official Pröpr Pilates booking platform or designated front desk channels.
5.2 Arrival & Late Entry Policy: Clients must arrive ten (10) minutes prior to the scheduled start time. For safety and class flow, late entry beyond 5 minutes post-start is strictly prohibited. Late arrivals will be turned away, treated as a "Late Cancel," and forfeit the full session credit.
5.3 Single Participant / Class Consolidation: Group classes require a minimum threshold of participants. If a client is the sole attendee booked for a scheduled group class, the Studio reserves the right to:

Convert the session to a Private Session upon payment of a PHP 350 Upgrade Fee; or

Cancel/reschedule the participant to another available group time slot with a minimum of two (2) hours' prior notice.
5.4 Instructor & Schedule Modifications: The Studio reserves the right to modify class formats, substitute instructors, or alter class times at short notice. Instructor substitutions do not entitle clients to cancellations, credits, or refunds outside the standard cancellation policy.
6. Strict Cancellation & No-Show Policy
6.1 24-Hour Cancellation Window: Cancellations or rescheduling requests for all classes and private sessions must be executed through the Studio booking platform at least twenty-four (24) hours prior to the scheduled start time.
6.2 Late Cancellations & No-Shows: Cancellations made within less than 24 hours (“Late Cancellation”) or complete non-attendance (“No-Show”) will result in the immediate forfeiture of the class credit or full session value.
6.3 Dispute Period: Clients have a maximum window of seven (7) calendar days from the date of credit deduction to lodge a written dispute regarding a deduction. Deductions not contested within 7 days are deemed final and non-reversible. Exceptions for late cancellations remain at the sole, binding discretion of Management upon presentation of verified emergency documentation.
7. Studio Etiquette & Standards of Conduct
7.1 Refined Environment: Clients are expected to conduct themselves with high decorum, courtesy, and respect toward fellow clients, instructors, village residents, and staff.
7.2 Zero Tolerance: Intoxication, vulgar language, harassment, discrimination, physical/verbal abuse, disruptive behavior, or property mistreatment will result in immediate ejection and permanent removal from the Studio roster without refund.
7.3 Digital & Noise Control: Mobile devices must be placed on silent/vibrate prior to class commencement. Voice calls inside exercise rooms are prohibited.
7.4 Cleanliness & Prohibited Items: Outside footwear, food, gum, smoking, vaping, or illegal substances are strictly forbidden inside studio rooms.
8. Attire & Grip Sock Policy
8.1 Required Attire: Form-fitting athletic wear is required to allow instructors to monitor movement alignment safely. Loose-fitting garments or clothing with sharp hardware, exposed zippers, studs, or metal buttons that can tear vinyl equipment are strictly banned.
8.2 Mandatory Grip Socks: For hygiene and safety, specialized grip socks are mandatory for all reformer and equipment-based classes. Entry will be denied without proper grip socks (available for purchase at the front desk).
9.1 Assumption of Risk: Pilates, equipment training, and physical exertion carry inherent risks of bodily injury. By participating, you voluntarily assume all known and unknown risks associated with your practice.
9.2 Mandatory Medical Disclosure: Clients are obligated to accurately disclose pre-existing medical conditions, injuries, pregnancies, or recent surgeries prior to participating.
9.3 Medical Advice Disclaimer: Instructors offer physical conditioning guidance only. No services rendered constitute medical diagnosis, physical therapy, or medical treatment. Clients must obtain independent clearance from a licensed healthcare provider before commencing physical activity.
9.4 Liability Waiver: To the fullest extent permitted by law, Pröpr Pilates, its owners, directors, instructors, employees, and village estate entities shall not be liable for any physical injury, illness, loss, or death sustained on the premises or through participation in Studio programs.
9. Health, Safety & Medical Clearance
10. Personal Property & Valuables
10.1 Personal Responsibility: Clients are solely responsible for their personal belongings. The Studio is under no obligation to secure or monitor personal property.
10.2 Limitation of Loss: The Studio assumes zero liability for lost, stolen, damaged, or misplaced items (including vehicles, bags, electronics, or jewelry) within the studio or surrounding village parking areas.
10.3 Unclaimed Items: Items left behind will be retained in Lost-and-Found for fourteen (14) days, after which they will be disposed of or donated.
11. Data Privacy Policy
11.1 Data Collection: Pröpr Pilates collects personal information (e.g., full name, contact details, emergency contacts, medical disclosures, payment histories) solely for account management, safety compliance, and service delivery.
11.2 Consent to Media & Promotional Capture: By entering the Studio, you acknowledge that photography and video recordings may occur in common areas or during classes. You grant Pröpr Pilates the royalty-free, perpetual right to utilize your image, voice, or likeness in marketing materials, social media platforms, and promotional assets, unless you explicitly submit a written opt-out request to Management prior to class.
11.3 Data Protection: Management takes all reasonable technical and organizational measures to protect personal data against unauthorized processing or disclosure. Data will never be sold to third-party entities.
12. Intellectual Property Rights
12.1 All branding, registered marks, logos, proprietary class sequences, workout materials, website layouts, photography, and marketing collaterals belong exclusively to Pröpr Pilates Studio.
12.2 Unauthorized reproduction, commercial distribution, or imitation of Pröpr Pilates assets or class concepts is strictly prohibited and subject to legal prosecution.
13. Studio Operations & Force Majeure
13.1 Operations & Closures: Management reserves the right to alter operating hours, adjust schedules, or execute temporary closures for maintenance, staff training, private events, public health guidelines, or emergencies.
13.2 Force Majeure: The Studio shall not be held liable or responsible for delay or failure to perform its obligations if such failures result from acts of God, extreme weather events, utility disruptions, village access restrictions, government mandates, or circumstances beyond reasonable control. No monetary refunds shall be issued for Force Majeure suspensions.
14. Severability & Governing Law
14.1 Governing Law: These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines.
14.2 Jurisdiction: Any legal dispute, claim, or litigation arising out of or in connection with Pröpr Pilates Studio shall be submitted to the exclusive jurisdiction of the competent courts of Cagayan de Oro City, to the exclusion of all other venues.
14.3 Severability: If any provision of these Terms is found invalid or unenforceable by a court of law, such invalidity shall not affect the enforceability of the remaining provisions.

1. Information We Collect & Purpose of Processing
PRÖPR Pilates collects personal data strictly necessary to provide safe, personalized, and efficient services.

Types of Data Collected: Personal identity details (full name, birthdate, contact details), emergency contact information, village visitor clearance details, payment/transaction histories, health/fitness disclosures (medical conditions, injury histories, pregnancy status), and digital usage data (IP address, website cookies, booking app activity).

Purpose & Legal Basis: Collected data is used solely to manage bookings, process transactions, facilitate security gate access into our residential village, tailor Pilates equipment modifications safely to your physical needs, communicate studio updates, and comply with legal or safety obligations.

2. Media Consent, Third-Party Sharing & Data Protection

Media & Promotional Usage: By entering the Studio or participating in classes, you grant PRÖPR Pilates permission to capture and use photography or video recordings of studio activities for promotional, social media, and marketing purposes. PRÖPR Pilates does not need to compensate you for proceeds from the videos. If you prefer not to appear in media, you may opt out at any time by submitting a written notice to Management prior to your class.

Authorized Third-Party Service Providers: Personal data may be shared with trusted service partners strictly as needed to operate our business—including encrypted payment gateways, automated booking platforms, website hosts, and village homeowner association (HOA) security personnel for gate access.

Security & Storage Safeguards: We implement technical, organizational, and physical security measures to protect your personal data against unauthorized access, loss, alteration, or disclosure. Physical intake forms are stored securely, and digital files are kept within encrypted, password-protected systems.
